SACRAMENTO The most severe penalty under state law has been handed down to a Yuba County nursing home after an investigation into the choking death of a resident last May.
Marysville Care Center, 1817 Ramirez St., in Marysville was fined $100,000 by the California Department of Public Health. The fine is the highest allowed under state law.
A report from the department noted an 84-year-old woman who suffered impaired decision-making abilities and was totally dependent on staff members for getting out of bed, choked to death when her head became stuck between a side bed rail and the bed.
The department quoted a coroner's autopsy report that said the woman's body was found lying partially on the floor, her head stuck between the bed and the lower portion of the bed rail. The autopsy report listed the cause of death as asphyxia, or lack of oxygen.
Among the conclusions in the state report was that "the facility failed to ensure that (the woman) was safe from accidents by not using a bed alarm that would have notified staff that (she) was getting out of bed."
No comment was available from Marysville Care Center on Friday; however, a spokeswoman for the department said that the facility had appealed the "AA" citation. No hearing has yet been scheduled.
