California will receive $5.6 million from Eli Lilly & Co., the largest part of a record $62 million settlement announced Tuesday by state Attorney General Jerry Brown.
The agreement with the Indianapolis-based drug maker ends a complaint by Brown and 31 state attorneys general alleging the company improperly marketed an anti-psychotic drug for uses the federal government hadn't approved.
The complaint also accused Lilly of failing to adequately disclose that using the drug, Zyprexa, carried side effects that included weight gain, hyperglycemia and diabetes.
The settlement also requires Lilly to restrict giving free samples of Zyprexa to health care providers whose practice aligns with the product's federally approved labeling.
The deal is the biggest ever multi-state consumer protection drug settlement, according to a Brown press release.
