A judge is scheduled to sentence Marco Antonio Topete for the June 2008 assault-rifle slaying of Yolo County Sheriff's Deputy Jose Antonio Diaz on a back road near Dunnigan. Jurors earlier recommended a death sentence, but Judge Paul K. Richardson must ultimately decide Topete's fate. He'll first have to consider another motion for a new trial from Topete's lawyers.
