Sacramento County jury convicts man of assault, animal cruelty

A Sacramento County jury has found a man guilty of assaulting his roommate and abusing his dogs.

Robert Brian, 48, was convicted Thursday of three counts of felony animal cruelty, one count of assault and one count of criminal threat, according to a Sacramento County District Attorney’s Office news release.

Brian was arrested Oct. 7, 2013, accused of assaulting and threatening to shoot a female roommate after an early morning argument.

After Brian’s arrest, Sacramento County Animal Care and Regulation officials received multiple complaints regarding the grave condition of Brian’s pit bull terrier, “Bubba.” On Oct. 8, 2013, the dog was impounded and immediately taken for treatment by Animal Control officers. Officials said the dog had suffered a fractured skull and snout, trauma to the right eye and face, as well as a massive infection and possible chemical burns.

The investigation found that a neighbor had seen Brian pulling the dog off the ground using a broken swing set, and choking and kicking the dog multiple times. The occupant of the house also reported hearing what she believed to be cruel treatment being inflicted on the dog from inside Brian’s living quarters, authorities said.

After Brian’s arrest, that occupant searched the back yard of Brian’s property and found the remains of three dogs. Only one set of remains was in a condition to allow for a meaningful necropsy, authorities said. After finding skull and facial fractures in that set of remains, Brian was charged with an additional count of felony animal abuse.

The surviving dog recovered from his fractures but lost vision in his right eye, authorities said.

Brian is to be sentenced May 2 by Sacramento Superior Court Judge Steve White.
