Judge takes teacher case under submission

A judge Friday took under submission lawyers’ arguments in McClatchy High School teacher Jerald Glaviano’s attempt to get his job back and the Sacramento City Unified School District’s effort to fire him.

Superior Court Judge Allen H. Sumner on Thursday issued a tentative ruling denying the district’s petition to overturn an administrative ruling that voided the school system’s termination of Glaviano. The district fired him last year for fighting with a student during a physical education class he taught. Glaviano said the student attacked him.

The tentative ruling, however, said that the Commission on Professional Competence overstepped its authority in ordering that the district return Glaviano to his old job at McClatchy.
