BDCP tunnels likely to fail in court

Re "Courts will decide tunnels' fate": DWR director Mark Cowin is wrong when he says state and federal agencies will determine whether the Peripheral Tunnels plan satisfies the complex laws that govern habitat conservation plans.
Courts will be making that decision and judging by the extensive comments that poured in responding to the draft proposal, Bay Delta Conservation Plan backers seem to have two choices: either go back to the drawing board and downsize the monster or be ready to lose court challenges.
Comments have made abundantly clear the current proposal doesn't square with required environmental protections for salmon and other wildlife.
