The Truth About Trusts: Facts You Have to Know

We've all heard about them. Some of us don't understand them. Some of us have already created them. Many of us need a better understanding of trusts and the benefits and problems associated with them. Essentially, a revocable living trust is a legal arrangement between three parties - the grantor or settler, the trustee and the beneficiary. All three parties may be the same person(s). Trusts are ordinarily used to avoid the problems of probate which otherwise can potentially deplete an estate by tens of thousands of dollars, particularly if the estate includes real property. Secondarily, trusts can be extremely beneficial for reducing estate tax liability. Unfortunately, many trusts were drafted in the "Trust Mill" explosion of the late 80's and early 90's were inappropriately structured, and never understood. Tremendous problems can result from these potentially dangerous documents.
