'narrative':'<p>I arrived and met a receptionist at 11:18 a.m. Within 10 minutes the department&#8217;s acting chief (chief was out of town) greeted me kindly. He said he needed my first name. I was given a Form 700 10 minutes later. I was told &#8220;no charge.&#8220; One hour later I was given a freshly printed crime log from Nov. 1 to Nov. 15. They said they do not normally keep them and it took that long to print a new one. It was 100 pages and did not list arrests. </p><p>I was told arrest logs were not printed for the public, but a clerk who was made to help me would not give a final, formal denial. The crime logs included all crimes, not just the ones I asked for. I was told that they did not keep public logs connecting arrests to crimes. &#8220;You would have to know what to look for,&#8220; a clerk said. I left at 12:41 p.m. &#149; Contando (the acting chief) called me in the morning of Dec. 12 and asked for the two week extension.</p><p> I received a phone message, timed at 3 p.m., that my documents were ready to be picked up. I did not have a chance to go until the following day. Copies of all available documents were given to me free of charge. A clerk could not tell me if this was special treatment, but I suspect they know I am a reporter. In addition to my written requests, there was also a printed summary of burglaries, sexual assaults and armed robberies. The report listed only a general location, time of the report and whether or not an arrest was made. An arrest log was not provided. Burglaries: 57 (arrests: 5); armed robberies: 4 (arrests: 1); sexual assaults: 6 (arrests: 0).</p>'

'narrative':'<p>Down the hill in historic old downtown Auburn, the much smaller Auburn Police Department was perhaps the most curious police operation we encountered.</p><p>Within minutes of our arrival at the department&#8217;s headquarters on Lincoln Way and request for information, no fewer than three department staffers became involved and started discussing the requests for information and documents we wanted.</p><p>First was friendly officer D. Coe, a bear of a man who had never heard about a Form 700 filing before but didn&#8217;t let that stop him from trying to help.</p><p>Thinking out loud, he asked what kinds of things could be found in a Form 700 report. When told that such reports included details about real estate and other investments, Coereplied: &#8220;You can get that property information at the County Recorder&#8217;s office.&#8220;</p><p>Just as Coe asked why we wanted the information, a second female civilian clerk jumped into the discussion after overhearing the discussion from her seat nearby.</p><p>&#8220;I think that (statement of economic interests) is only a Public Record at federal agencies,&#8220; she offered, skeptical that ordinary police chiefs have to file them, too.</p><p>That&#8217;s when the sly, polite and deadly curious Lois Montgomery, an Auburn Police Department records officer and dispatcher, got involved as well.</p><p>Montgomery was initially dismissive, explaining that it was the Monday after a weekend of policing, there was tons of paperwork to be done and that she was very busy and that her dispatch was under construction to boot.</p><p>&#8220;We have 600 things to do right now,&#8220; she said. &#8220;I think we have five days to get that to you.&#8220;</p><p>Then curiosity got the better of her. &#8220;Why do you want this stuff? Are you an attorney? Are you doing some kind of project?,&#8220; she asked, warming up and smiling.</p><p>&#8220;Does it make a difference if I am or why I want the information?,&#8220; our auditor countered, with a smile himself, saying it was for unspecified research.</p><p>&#8220;Well,&#8220; she replied. &#8220;We never get asked for any of this,&#8220; Montgomery said. &#8220;We&#8217;re a small police department in a small town with a 13,000 population.&#8220;</p><p>She offered a free copy of a one-page sheet pasted to the service counter window which outlined the Department&#8217;s fee schedule.</p><p>In Auburn, if you want a copy of police radio recording, you have to provide the blank, new tape and $16. Ditto for Video tape requests. Incident and collision reports cost $5,00, plus 10 cents a page per page if the report exceeds 10 pages.</p>'

'narrative':'<p>At the CHP detachment building in Newcastle, which serves the Auburn area from a perch above the highway on Indian Hill Road, a receptionist at the front desk was abrupt, nosy and demanded to know the identity of the auditor and why information was sought. When the reporter replied, does it matter who I am and will it make a difference? Will it change how you handle my request, she sighed and frowned, stood up and curtly replied that she would get a uniformed officer to respond. Four minutes passed and along came CHP Watch officer Kevin Mendonca, a welcome breath of fresh air. He was friendly, polite and eager to serve and provide information. In fact, his detachment was a model for all CHP detachments. It had two posted copies of the department&#8217;s Public Records Act policy: one large version that was affixed to a bulletin board in its entrance area and a second smaller photocopy taped to the inside of front service counter window. He provided a copy. The document explained the guidelines under which the CHP releases communications center tapes, commercial vehicle inspection reports, dispatch logs and hazardous spill incident reports, citing an exception to the latter for injury and medical information. The document also listed the CHP&#8217;s fees for such tapes and copiers of documents, added that &#8220;public records requests shall not be disruptive to normal business.&#8220;</p><p> A smiling and efficient Mendonca took extra steps to ensure he understood exactly what was being requested, but he too, eventually wanted to know the auditor&#8217;s identity and why the information was being requested. He asked for a driver&#8217;s license and took down the details and then quickly printed the Auburn office&#8217;s arrest log for between Nov. 1 and 15 - it reported 29 arrests - Âand provided the two-page printout document at no charge. There were 20 DUIs. He accepted a reporter&#8217;s public records request, read it carefully and said he would have to forward to the department&#8217;s legal office - which he did that same day. The auditor was in and out of that office within 20 minutes. 12/28 Letter stating that documents will be provided on or before 1/10.</p>'

'narrative':'<p>At the Williams office of the California Highway Patrol, a reporter asked for a copy of information on drunk driving arrests over a certain period of time. At two other Highway Patrol stations, the reporter had been able to get the information immediately. First, after waiting a couple of minutes, the reporter was asked why he wanted the information. He replied that he was a journalist working on a story. A few more minutes passed and he was taken into the office of Doug Uhlik, the area commander. Uhlik asked the reporter to show identification. He then took the reporter&#8217;s official id card and made a photocopy of it. He then asked why the reporter needed the information. The reporter said he could not disclose that. </p><p>Uhlik, who said it was his first day on the job, then had an employee take the reporter&#8217;s address and said he would get the information to him. First, he said, he had redact some information he said was not open to public inspection. 'narrative':'<p>Closer to Sacramento, trying to get information from the six-month-old Citrus Heights Police Department was a little more difficult, despite earnest efforts by several police and city employees.</p><p>When an auditor went to the public service counter of its sparkling police department headquarters, a volunteer senior citizen serving behind a glass window said all the information we needed could be found in a recent Sacramento Bee article about the department&#8217;s accomplishments and activities under Chief Christopher Boyd.</p><p>The senior, who was wearing no identification other than a ÒvolunteerÓ designation, wanted immediately to know who we were and why we wanted the information.</p><p>When an auditor replied, ÔDoes that matter? Will it make a difference?,Ó he became impatient and summoned a civilian police records officer: a young woman reluctant to disclose her identity to a stranger. She was L. Wasilasky.</p><p>She disappeared for about 12 minutes before returning with a reply.  Somewhat embarrassed, she explained Citrus Heights Police Department is building a Web site where it will post crime and arrest information, but added the Web site is not ready yet.</p><p>Instead, she said a department crime analyst would retrieve the information requested and get it to us within Ò a couple of days,Ó Wasilasky added.</p><p>As for the Chief of Police&#8217;s Form 700, she directed us to walk across the street to Citrus Heights City Hall to pick up a copy of the document there.</p><p>Over at City Hall, main receptionist Lativa was efficient, fast and courteous, serving the many walk-in builders seeking permits, and citizens with questions about services.</p><p>She was as good as the best traffic cops the city.  But she was stumped by the Form 700 request, saying she didn&#8217;t have one and had never seen one. </p><p>She called and paged a staffer in the Chief&#8217;s secretary repeatedly for the next 35 minutes to ask for it, but had nothing to show for her tenacious efforts. She finally took a message and urged the auditor not to hand around any longer, suspecting people were caught in a lengthy meeting or something. She logged the message in a receipt book and the auditor left an e-mail address through which he could be contacted.</p><p>The next day, the Chief had learned that the Bee&#8217;s queries are part of a statewide audit and he called a senior Bee editor to find out what is going on and also to complain.</p>'

'narrative':'<p>&#8220;On Dec. 4, just before 9 a.m., I went to the station. The front desk clerk recognized me immediately, though I&#8217;m not our regular police reporter. She accepted the requests but said the station was short-staffed. I offered to wait, but she said she would not be able to get to any of them that day. I was given the name of the head of the records department, Karen Berry, and was told she&#8217;d contact me. Within about two hours, the interim chief called my editor, Debbie Davis. Unfortunately, Debbie did not stick to the script, explaining what was going on. The chief said he&#8217;d fulfill the requests within 10 days. He later called and e-mailed me a couple of times with questions and in one voice mail mentioned that he and others were working on the requests. Certainly not the sort of situation a normal citizen would encounter, I&#8217;m sure. However, I suppose it says something that the interim chief knew exactly what these requests were for, but it still took until 12/13 -- nine days -- to fulfill them. What that says likely varies widely depending on your point of view. <p>The department did, indeed, fulfill the requests, at least partially, with two exceptions:</p><ul><li>The record of asset forfeiture fund disbursements is, according to the chief, held by the finance department. When the chief provided his packet of responses to the requests, he wrote that he was waiting on the finance department to get him that information. Ultimately the chief contacted me with them on 12/18.</li><li>Office second job records: The chief wrote, &#8220;&#8220;The Department has records responsive to your request, but they are not available for public inspection as any records indicating second jobs held by the Department&#8217;s peace officers are maintained in that officer&#8217;s personnel file. Peace officer personnel records exempt from disclosure pursuant to Penal Code section 832.7. The Department has not compiled separate records or statistics with this information since such officer requests to accept second jobs are generally handled as individual personnel matters. The Department has a policy entitled &#8217;Extra Duty and Off-Duty Police and Procedure&#8217; that addresses the general parameters of what is taken into consideration in deciding whether to grant an officer&#8217;s request to accept a second job. He also gave me the name and number of a crime statistics analyst from the department when I asked to see the crime and arrest reports.</p><p>He said he wasn&#8217;t aware of what a Form 700 was. He also kept saying he didn&#8217;t know what records can or cannot be released.</p><p>&#8220;And to be honest, most of the officers working here probably don&#8217;t either,&#8220; he said.</p><p>He said crime reports were available on the department&#8217;s Web site, but detailed information wasn&#8217;t public unless the person requesting it was the victim.</p><p>&#8220;The names of victims or suspects wouldn&#8217;t be public information,&#8220; he said.&#8220;</p>'

'narrative':'<p>On December 4, 2006 at 8:30 AM, auditor entered Fresno County Sheriff&#8217;s department.</p><p>Auditor describes her experience as &#8220;getting the run-around.&#8220; When auditor made oral request, department employees bounced auditor between two different offices. Employees never heard of Form 700 and asked auditor a series of questions, &#8220;where did you hear about this Form 700. Where did get this information? How did you know about the Form 700.&#8220; Auditor said she&#8217;s working on a project and needed the form for the project. Auditor did not reveal her affiliation with the media.</p><p>The employees sent auditor to an outside patio telephone to be connected to a supervisor. Paul LeDuc, Systems and Procedures Manager, asked auditor a series of questions, &#8220;He asked me my name. He asked me if I was a citizen or employee of that department, and asked me what I wanted the information for.&#8220; Auditor provided her name, identified herself as citizen, and said she&#8217;s working on a project.</p><p>In regards to the other oral requests (crime info & arrest info), Auditor said, &#8220;He (LeDuc) wasn&#8217;t sure whether or not that information could be given to me and he would have to find out what if any of the information could be given to me ... how detailed the information could be. If it was very detailed, they would have to give their IT department involved.&#8220; After an hour of waiting and questioning, auditor finally submitted the oral and written requests to Steve Forker, Administrative Services Director. No information was immediately provided for inspection.</p><p>Auditor left building at 9:30 AM.</p>'

She (clerk) came back and said we&#8217;ll have to get back to you in ten days.&#8220; It turns out the clerk made a copy of auditor&#8217;s license. Auditor reported, &#8220;I saw her (clerk) over at the photocopy machine ... copying my ID. I asked her when she brought it back to me if she made a photo copy of my ID and she said she had.&#8220; Auditor was asked to submit her oral request in writing. Clerk asked why auditor wanted information and a few clarification questions. Auditor said she wanted information for her own personal interest.</p><p>Then, auditor submitted written request. No further questions were asked. No information was immediately provided for inspection.</p><p>Auditor left building at 10:33 AM.</p><p>On 12/11/06, Lt. Newton called Angela for clarification on what she means by &#8220;recent.&#8220; Angela returned the call on 12/12/06 saying she wants all reports for the year 2006.</p>'

When I asked him if that was necessary, he told me &#8220;they&#8217;re going to ask who wants to know.&#8220;</p><p>I was ultimately directed to Denise M. Robsel, a records administrator. She seem perplexed by my requests, giving me other people to contact for the information. She was very friendly, though, as was the desk officer.</p><p>I noticed a reporter looking at printed out computer logs and asked whether those wouldn&#8217;t have some of the information I sought. She told me I could look at them, but that names of the arrested were blacked out because &#8220;the courts have ruled that after seven days, an arrest becomes part of someone&#8217;s criminal history, and we can&#8217;t release that.&#8220;</p><p>None of the other information was provided, although a few days later, I received phone calls from someone in the city attorney&#8217;s office and a police lieutenant in charge of public information. I called the lieutenant back and spoke to him, then got another call from the city attorney. I did not talk to her because of the holidays.</p>'

'narrative':'<p>I entered the driveway at 3:08 and stopped at the guard booth. The deputy in the booth asked me what I was there for and I told her it was to get some documents. She asked if I had documents waiting for me, and I said no, I wanted to request some documents that were public records. She asked if I had been told by someone at the headquarters that this was the place to get the documents, and I said no, and she explained that this was the headquarters, not a station, so I probably wouldn&#8217;t get any documents.</p><p> Then she said she would call up and tell someone I was coming and she asked my name. I asked if she needed it and she said yes, so I gave my first name; then she asked for my last name and I again asked if she needed it, and she said yes, because I was at a sensitive facility and that Òthis is where Sheriff Lee Baca works.Ó So I gave her my last name and she called up, and she gave my name, and then she gave me directions for how to park. </p> <p>I entered the front lobby at 3:14 and asked the deputy at the front desk to direct me to the person handling public records. The deputy asked me what sort of records I was looking for, so I began asking him about the Form 700. Then the sheriff&#8217;s spokesman, whom I know, came through the lobby. He recognized me and asked what I needed. So I read the oral request form to him, and he came to look at the oral request form. He expressed concerns that the request was very vague Ð did I want a form 700 for the Sheriff? Or for the undersheriff, the highest non-elected official? Or for all of the 15-20 commanders working out of headquarters? And he said the oral request paper looked like a form letter and that I must be just going to several different locations with the same questions, right? I couldn&#8217;t think of a form of the question ÒDo you need to know that?Ó that would have made sense under the circumstances, so I said something like ÒYeah, sort of.Ó </p<p>He explained that most of my questions were too vague Ð for instance, did I want the crime data for the entire Sheriff&#8217;s Department? Or for just Monterey Park, where the headquarters was located, but which the department does not actually serve? He said I needed to specify those details, and that they don&#8217;t have those kinds of records at the headquarters anyway, and my best bet would be to go to the Discovery Unit or to a station. He recommended that I write up my oral requests as a letter to the Discovery Unit, and he and the front desk deputy gave me the address for the unit, the main phone number, and the name and extension of a specific contact in the Discovery Unit. When I presented my written requests, the spokesman had similar concerns (that they were too vague) and told me to fax that to the Discovery Unit as well. I asked if I could leave either of my requests at the headquarters, and he said no, he would not accept the oral or written requests because the requests needed to go to the Discovery Unit.</p><p> I left at 3:23. The spokesman left at the same time, and said the Discovery Unit would be able to help me, and added that the Sheriff&#8217;s Department always responds promptly to requests.</p>'

'narrative':'<p>&#8220;I spoke with Felisha Willis, who was very kind but didn&#8217;t understand what I was looking for. So she got someone from Crime Analysis to help me. They asked, who I work for. I said The Modesto Bee. Then they sent me up stairs to the press officer. He was not in. I explained to Tammy in administration what I was looking for and she sent me back down stairs to meet with Lt. Kevin Finnerty. Felisha gave me two forms to fill out. I filled out one because the other didn&#8217;t seem to apply. Finnerty said that was fine. Finnerty said he may call me with questions because there are some limitations with regards to open records.</p> <p>Dec. 11</p><p>Got a call that the documents were ready and would cost $63 because they had to compile copies of everything. When I went to the office, Finnerty said &#8220;You&#8217;ve been busy,&#8220; alluding to the audit. I said, so you know I&#8217;m with The Bee and everything? He said &#8220;Yes. But I&#8217;m not probing.&#8220; He left me with the city attorney&#8217;s assistant. I pointed out that the letter states I only wanted copies of the last two items on the list. Rosie Gomes (sp?) said I could just pay for what I was taking.</p><p>I paid $9.80.</p><p>Then Cynthia Fuzie went over the material w/ me. I asked if she knew I was a reporter and everything. She said yes, but you are also a citizen.</p>'

Bonner was not available at the counter but may either be available online - it wasn&#8217;t - or from the county personnel office.</p><p>It turns out that Placer County Sheriff places a daily report of its arrests and bookings into the jail on its Web site, including the arresting police agency, names of suspects, booking dates and times, age, gender and their alleged offenses and details about their bails.</p>'

'narrative':'<p>On the morning of Dec. 4, I spent about 20 minutes at the Red Bluff Police Department. When I asked to see the Form 700, the Records Specialist asked to see my note card, which I provided. She took it, went to speak to a co-worker, then came back. She told me to go down the hall and ask the city clerk about it because they didn&#8217;t have that form in their office. The county clerk provided the form right away and didn&#8217;t ask any questions. But she stood at the counter and curiously watched me take notes in a little pink journal the whole time. </p><p>The form was pretty much useless as it stated that the police chief didn&#8217;t have anything to report. It didn&#8217;t even show his income. I then went back down the hall to the police department and asked about the crime and arrest info. I had to provide the note card once again. I also had to provide my name, explain why I wanted to see the information and then fill out a form which asked for my name, address and, if applicable, who I was in relation to the crime/arrest. I told her I was doing some personal research. The records specialist told me that the department had 10 days to fill my requests. I provided her with the written requests and she said that would also take 10 days to fill. I asked her to call me when each document was ready and she said that she would.</p>'

'narrative':'<p>I entered the lobby at 10:20 a.m. where there were 60 elementary school children and several adults crowded inside waiting to tour the police station. After a several minute wait to talk to the clerk behind the glass, I raised my voice to read the card into the microphone. The woman had a blank look and asked what agency I was with, and I told her I was a private person needing the info for a story project (I failed to ask beforehand if telling her was a requirement to get the info, but she didn&#8217;t press me for my name and I didn&#8217;t have to give it nor say I was with the paper). She asked me what I wanted and as I read the card a second time, she relayed the info over her phone to someone else. I was told to wait for someone to come out. After about 5 minutes, Chris Fountain, the office services supervisor, came out to talk to me. I went through the same request routine and was told Form 700 wasn&#8217;t at the office but kept on file at City Hall. As for the crime and arrest info, I was told that information wasn&#8217;t immediately available because the department no longer had a crime analyst on staff and three or four other people in the office were handling those duties. She said I might be able to get that information the next day, but what she would do is make a copy of my request and let Capt. Chuck Lebak handle it. Then I read the script for the written information request and handed her the written request. She gave me Capt. Lebak&#8217;s business card. She acknowledged that all the information I was seeking was public information, but I left the office at 10:45 a.m. empty-handed.</p><p>Side note: Our two regular police/crime reporters were sent to agencies out of town so they wouldn&#8217;t be recognized at our hometown police/sheriff&#8217;s departments. Unfortunately, the only person I know at the Redding police is the wife of a buddy who also works at the newspaper, and she (Chris) was the one who came out to speak with me. About halfway through our conversation, when I asked for her name, she remembered who I was. She treated me the same at the beginning of the conversation as toward the end, so I don&#8217;t think there was any undue influence there, but what I don&#8217;t know is if she&#8217;ll tell her captain that the requests were coming from someone at the paper.</p><p>Update: No return call from Capt. Lebak as of 4 p.m. Monday</p><p>On my own, I later went to Redding City Hall for the chief&#8217;s Form 700. The clerk asked me my name and when I asked if it was a requirement to get a copy, she said no. The 2-page report cost me 20 cents. Interestingly, the box &#8220;&#8220;no reportable interests on any schedule&#8220;&#8220; was checked. No income? No loan for a home? No investments?</p><p>At midweek, I received a call from Assistant City Manager Randy Bachman inquiring as to what I was up to. I know Randy personally, and he thought it was strange to see my phone number on the request with a 360 Washington area code ( I just moved back to Calif.). He said he wanted to make sure it was me. I called him back but couldn&#8217;t answer his questions. He said the chief learned that Shasta County received the same request and also Wheatland.</p><p>I received a phone call from the Redding city attorney&#8217;s office, from the legal assistant, on Friday, Dec. 8. We made an appointment for me to go into the office on Monday, Dec. 11, at 1 p.m. to go over the requests. My managing editor, Greg Clark, said I didn&#8217;t have to go into the appointment, so I called back asking whether going in was a requirement to get the information. I was told that it wasn&#8217;t a requirement. So I had a phone conference that Monday and set a time for Friday morning, Dec. 15, to go to the city attorney&#8217;s office at city hall to review and pick up the copies. 'narrative':'<p>Jay Rogers, a peer support counselor with Sheriff&#8217;s technical services division, said he had no idea what a Form 700 was when I asked to see it. He was polite and cordial and generally tried to be helpful. He made two phone calls inquiring about the form and said later &#8220;someone heard of it anyway.&#8220; He wrote down the name of a person I could approach at the County Clerk&#8217;s office (on 8th and F). He directed me to the department&#8217;s legal division on 5 29th St. when I wanted to submit my written requests.</p><p>Rogers said crime reports aren&#8217;t public information unless the person requesting to see it is the victim. He said arrest reports are only public within 24 hours and contained in a basket by the inquiry window.</p><p>He also required me to produce identification and to fill in a form declaring under penalty of perjury that I am not a criminal defendant in the crime or arrest reports I was seeking. The form also required me to declare under penalty of perjury the reason I was asking for the information. I blew my cover at this point when I checked the &#8220;journalistic&#8220; option. He wanted to see my credentials as a journalist, which I didn&#8217;t have on me.</p><p>When he asked me to divulge my social security number, I asked him why that was necessary. He said that was to make sure I hadn&#8217;t committed a crime that he would have to arrest me on the spot.</p>'

'narrative':'<p>&#8220;Out of the six departments I visited, the Sacramento Police Department had the best &#8220;customer service.&#8220; The officer at the information counter was perplexed about the Form 700, but asked me to take a seat while he dealt with my request. He also suggested I could take a ticket number and wait for one of the police counters to become available.</p><p>After about 25 minutes, Genna Tanner, the department&#8217;s administrative technician, appeared with a captain, who showed me a printout of one of the department&#8217;s Web pages. The sheet listed the chief&#8217;s salary and description of his job.</p><p>I said I would like to see the actual Form 700, which would detail the chief&#8217;s economic interests, including property holdings and investments. Tanner said she is sure the department has it, but it would take time to locate it. At one point, she asked me to wait while she tried to obtain the crime and arrest reports I requested, and was apologetic when she returned empty handed. She said didn&#8217;t have them at her fingertips.</p><p>But she was very willing to take my written request, along with the oral ones, and said the department will try to get back to me within 10 days. She didn&#8217;t interrogated me about my purpose and even said at one point, &#8220;&#8220;just out of curiosity, and you don&#8217;t have to tell me if you don&#8217;t want to, what is this for?&#8220;&#8220; She said the department is accustomed to dealing with such requests for public records, and providing them should be no problem, once the legal counsel has reviewed them.</p><p>(On Friday, she called me to say the Form 700 was available for inspection.)&#8220;</p>'

He asked what I need the information for, saying that will help him figure out what I needed. Then he asked if the information was needed for legal reasons or for school homework. If it was for legal purposes, he said I would have to subpoena for it. &#8220;We&#8217;re not going to just hand out this information to anyone,&#8220; he said. I told him it was for research. He left the front window several times to consult with someone else about my requests, but kept returning to tell me I couldn&#8217;t look at citations and arrest information unless I told him why I wanted it. He also gave other reasons why I couldn&#8217;t see them, including the fact that the cases I was asking to see have not been abjudicated yet.</p><p> Eventually he brought out Mary Henriksen, Office Services Supervisor II, who wrote down the numbers for the department&#8217;s public affairs and legal coordination divisions. She also suggested I contact the main CHP office in Sacramento, where earlier an officer told me no records were kept. She also told me the citations and arrest information I wanted weren&#8217;t public records unless I was the person involved or if the person involved allowed me to see them. Henriksen and the officer both refused to forward my written request.</p>'

Carlson said the department releases information on a need to know basis only. Carlson said the only information available was what was published in the newspaper but could not provide me with a copy. She said crime reports for Nov. 1-15 were not yet available in her office.</p> <p>Carlson said she understood about the public records act but said the public thinks it can get any record but it can&#8217;t. She recommend I go< online to read about what information I&#8217;m allowed. Carlson said records of arrests are not kept for more than 7 days because the law does not allow them to track people. Crime information for sexual assaults are not available because of privacy.</p> <p>I could request crime statistics but would be required to provide identification, including driver&#8217;s license number, reason, and I would be charged for the request.Carlson could not help me with the written request after reading it. She said they have a PIO who assists reporters&#8217; requests for information. I said I only wanted what was available to the public. They would not take the form.</p><p>I was sent to the chief of police&#8217;s secretary for form 700 and the written request. They said city hall would also have form 700. Chief of police is Susan Manheimer.</p>'

Margo Rohrbacher came up shortly afterward and I asked to see the crime and arrest information for all burglary, armed robberies and sexual assaults occurring between Nov. 1-Nov. 15, 2006. She immediately provided me with binder of all reports from the last few months and directed to me a seated counter where I could leaf through them. I asked her if I could also obtain a copy for Form 700 for the chief. She said I could get a copy today from the City Clerk upstairs. I did not visit the City Clerk&#8217;s Office.</p><p> As I was flipping through the book, Margo asked me if there was something specific I was looking for. I said I was just counting the number of reported incident and subsequent arrests. She said me if I was with the press. I said yes. She asked what paper. I said the Contra Costa Times. She said let me know if I need anything us. I said I would. She said she didn&#8217;t know where to begin to find to that report, and suspected it didn&#8217;t exist.</p><p> I agreed to withdraw my request for that item. She then accepted my written request and hand wrote a time stamp: 12/4/06, 1200 hrs. On 12/14/06 I received a letter at my home address from San Rafael Deputy City Attorney Eric T. Davis. The letter was dated 12/13/06. The letter says, &#8220;The city will make available for your inspection and review all existing records responsive to Items 1-3, and 8-10. With respect to Item 7, I understand that you withdrew that request after you were informed that the City does not maintain a jail facility and that the last death in custody for our Police Department occurred more than 15 years ago. &#8220;With respect to Items 4-6, it is the City&#8217;s position that the requested records contain confidential personnel or medical information, and are privileged or exempt from disclosure by one or more of the following statutory or constitutional provisions: Government Code Sections 6254(c), 6254(k) and 6255, Penal Code Sections 832.7(a) and 832.8, Civil Code Section 56.13, the right to privacy under Article 1, Section 1 of the California Constitution. 'narrative':'<p>I read my request to the criminal records tech at the front desk, Kelley Kerns.</p><p>She told me that she was the only one in the office for the day, and all of her superiors were gone, suggesting I come back later or the next day.</p><p>She very nicely said she couldn&#8217;t help me because, &#8220;We&#8217;re really shorthanded and we&#8217;ve got a lot going on.&#8220;</p><p>I asked her to make a copy of both my cue card and my written request and give them to her supervisors.</p><p>When asked for a time stamp, she said she didn&#8217;t have one but could stamp my document with the date and write down the time, which she did.</p><p>I left, but not before I heard this gem of a quote.</p><p>Seeing my amusement at the whole situation, Kerns smiled, shrugged and said, &#8220;This is Siskiyou County.&#8220;</p><p>That says it all.</p><p>I highly doubt that my public records request even made it to someone&#8217;s desk.</p>'

She said the agency has 10 days and a supervisor first has to look over the records requested.</p><p>The city attorney, in an email regarding the oral and written requests, said I had to get the police chief&#8217;s Form 700 from the City Clerk&#8217;s office. It was provided at City Hall.</p><p>The crime information provided by the police department appeared to be copies of the police blotter. I know that some agencies in our region (Manteca, Merced) let newspapers look at their police blotters on a daily basis. It took me nine days to get access to this information.</p>'

He took down my full name and phone number so he could contact me later.</p><p>Vaca PD, after calling twice - first to ask why Jennifer wanted the information and then to inquire if she was with the San Jose Mercury News -- later referred her request to the City Attorney&#8217;s office. On 12/15, she received a letter AT THE REPORTER from the Police Department, which is attached. She had not given ANY address during her contacts with police and city officials, so we are interpreting the incident as the City and Police Department saying &#8220;We know who you are.&#8220;</p>'

When I responded that I was from The Davis Enterprise, I was given the press log, which included arrest reports dating back to the beginning of November.</p> <p>When I asked for the 700 form and the crime logs for Nov. 1-15, I was told I would have to get those through the police chief&#8217;s secretary and the department&#8217;s media spokesman, respectively, both of whom were not in the office that day. I then handed over my written request, which I was told also would be submitted to the media spokesman, Lt. Dave Farmer.</p> <p>On Dec. 6, I received a phone call from Police Chief Dan Drummond, informing me the 700 form was available for pickup at the police department.</p> <p>I received a letter, dated Dec. 14, from City Clerk Kryss Rankin requesting an eight-day extension to the 10-day time limit for the agency&#8217;s response. On Dec. 22, I received a fax from the police department&#8217;s law firm, denying disclosure of some documents and informing me that others -- including the crime and arrest information originally sought in my oral request -- would be made available by the city, with a copy fee of 10 cents per page.</p>'

'narrative':'<p>At the Wheatland Police Department in rural Yuba County, visitors have to use an intercom to get into the headquarters. A reporter buzzed Monday and, when a patrolman came to the door, the reporter asked for three items state law deems public information. The reporter was immediately asked what he needed the information for.</p><p>When he replied that he was a newspaper reporter and needed it for a story, the reporter was taken to the office of the police chief, Dan Boon.</p><p>Boon read over a card detailing the three items requested and, at first, was cooperative. He called the city clerk&#8217;s office to get them to pull a requested form - a statement of his economic interests that he was required to complete on taking the job.</p><p>But then Boon got testy. He asked why the reporter needed the information. The reporter said he wasn&#8217;t allowed to disclose that - if he told Boon a statewide audit was taking place, Boon might have told another police agency and compromised the entire audit.</p><p>Under the state&#8217;s public records law, no reason needs to be given to inspect public information.</p><p>Boon did not accept that answer. He said, given the nature of one of the forms requested, it was clear that the Bee was initiating an investigation of him. When asked if this was the case, the reporter again said he could not detail why he was requesting the information.</p><p>Boon said that answer was &#8220;bull&#8220; and that &#8220;someone was blowing smoke up his rear.&#8220;</p><p>He then said he was going to have to call his attorney to get him involved in the matter.</p><p>After another couple of minutes, Boon asked for the name of the reporter&#8217;s boss. The reporter gave it to him and then, with the reporter still there, Boon called the reporter&#8217;s boss, expressing his frustration.</p><p>Boon said he could not get the other items requested because the employee who handled them was on vacation.</p><p>After spending another five minutes trying to get more information from the reporter, Boon led him to the door. As he left, the reporter -- to ease Boon&#8217;s mind - told Boon that he was not specifically under investigation but again refused to say anything more.</p><p>Later in the day, Boon sent the reporter an email.</p><p>&#8220;I did verify your employment with the Sacramento Bee following our meeting this morning in my office at the Wheatland Police Department,&#8220; it began.</p><p>The reporter was able to get the one form Boon initially promised from the city clerk soon after leaving Boon&#8217;s office. By the next day, he still didn&#8217;t have the other information.</p><p>Bee Editor had conversation with Chief. Chief indicated that recent activity at the police station (a drug related break-in) had officers on-edge, which may explain the reaction the auditor experienced from officers on the day of the audit.</p>'

She referred me to the city clerk&#8217;s office for the 700 form, which also was provided to me immediately with no questions asked.</p> <p>I then submitted my written request, after which Beckett did inquire why I wanted the information. I acknowledged being a reporter doing a story and was not questioned further.</p> <p>After leaving the department, I received a phone call from the police chief, Bruce Muramoto, who recognized my name on the request and asked why I needed the information. I did not disclose a reason.</p> <p>On Dec. 14, a packet containing the documents the agency opted to release were hand-delivered to me at the Enterprise&#8217;s offices in Davis. Items number 4, 5 and 6 were not disclosed.&#8220;</p>'

'narrative':'<p>&#8220;I entered the Woodland Police Department lobby and was assisted by senior records specialist Stacey Briggs. She informed me that the arrest and crime reports for the first two weeks of November had already been shredded and that I would have to request information from the department&#8217;s crime analyst, who was not in the office that day. Nor was the chief&#8217;s secretary, who would be the person to provide me with the chief&#8217;s 700 form.</p><p>My written records request was forwarded to Shelby Munn, the department&#8217;s records manager, who also had the day off. Briggs, who asked why I wanted the information but did not ask who I was, said she would forward the request but warned that there were several items on the list that likely contained private employee information and probably would not be provided to me.</p><p>Munn, the records manager, phoned me the next day, Dec. 5, to inquire why I wanted the information requested. I acknowledged being a reporter doing a story, and she did not question me further.</p><p>Lt. Charles Wilts was later put in charge of the written request and was very responsive, making several phone calls over the course of the next several weeks to keep me updated on the process of gathering the documents. I received a letter dated Dec. 8 requesting a deadline extension, and a second letter, dated Dec. 28, was sent informing me which documents would be disclosed, which ones would not, and copy fees.</p>'

'narrative':'<p>It took just a few minutes for me to receive a copy of the sheriff&#8217;s 700 form. I was told that arrest reports -- but not the crime reports -- would be available at the county jail building, next door to the sheriff&#8217;s administrative building.</p><p>My oral request for the crime and arrest reports for Nov. 1-15 were submitted to the department&#8217;s crime analyst to compile. The written record request was submitted to Capt. Tom Lopez, who informed me that my request would be forwarded to the Yolo County counsel&#8217;s office to determine which documents would be disclosed.</p><p>I was recognized as a reporter early on by both the sheriff, Ed Prieto, and Capt. Lopez. Prieto asked why I needed the information, but I did not disclose a reason.</p><p>On Dec. 18, I received a phone call from the Yolo County counsel&#8217;s office, informing me that I could arrange to review the documents listed in the written request, with the exception of the officers&#8217; second jobs, worker&#8217;s compensation claims and individual officers&#8217; salary schedules, which the county would not release. However, I was told I could obtain general salary information for the sheriff&#8217;s employee positions.</p><p>I still have not heard back from the sheriff&#8217;s department re: the crime and arrest reports asked for in the oral request.</p><p>Note: The sheriff personally was very responsive to the requests, directing his staff to get me whatever on the list I was entitled to see.</p>'
