THE STATE SCHOOLS SUPERINTENDENT IS URGING SENATE REPUBLICANS TO PASS THE STATE BUDGET, SAYING THE OVERDUE BUDGET HAS RESULTED IN A CUT OFF OF FUNDS TO 785 CHILD CARE AGENCIES. THE REPUBLICANS SAY SENATE DEMOCRATS BLOCKED A VOTE FOR A BILL TO TEMPORARILY FUND THE CHILD CARE CENTERS.

THE STATE BUDGET IS NOW 40 DAYS OVERDUE. SUPERINTENDENT OF PUBLIC INSTRUCTION JACK O'CONNELL SAYS THE LEGISLATURE'S FAILURE TO PASS A BUDGET HAS ALSO RESULTED IN A STOPPED PAYMENTS TO SCHOOLS AND SPECIAL EDUCATION PROGRAMS THAT HAVE BEEN OPERATING DURING THE SUMMER MONTHS. O'CONNELL MADE HIS REMARKS THIS MORNING AT A SACRAMENTO CENTER THAT PROVIDES FREE CHILD CARE, AND RECEIVES 90 PERCENT OF ITS MONEY FROM THE STATE.

ACKERMAN'S RESPONSE TO PERATA'S SUGGESTION TODAY IN RODEO THAT REPUBLICAN SENATORS ACCEPT WHAT HE DESCRIBED AS A REPUBLICAN BUDGET THE ASSEMBLY PASSED:

SAYS: "SENATOR PERATA HAS ADMITTED HIMSELF THAT THE BUDGET THEY SENT OVER HERE WAS FLAWED. THERE WAS A TAX PACKAGE ATTACHED TO IT WHICH HE HAS ALREADY REFUSED TO TAKE UP. SO THE ENTIRE PACKAGE THEY SENT OVER HERE HE HAS NOT EVEN TAKEN UP. HE'S ALSO ADMITTED THERE WERE A NUMBER OF ISSUES WITH THE TRAILER BILLS THAT THEY SENT OVER, SO THE PACKAGE THEY SENT OVER IS NOT, NOT A TOTAL PACKAGE."

REPUBLICAN SENATORS SAY AS A CONDITION OF APPROVING THE BUDGET, THEY WANT A BILL TO BLOCK ATTORNEY GENERAL JERRY BROWN FROM FILING LAWSUITS BASED ON CLAIMS THAT INFRASTRUCTURE PROJECTS AND LOCAL GOVERNMENT LAND USE DECISIONS DON'T CONSIDER THE ENVIRONMENTAL IMPACTS OF GREENHOUSE GAS EMISSIONS. ACKERMAN SAYS REPUBLICANS WANT THE BILL PASSED WITH THE BUDGET, BECAUSE DISTRIBUTION OF 40 BILLION DOLLARS OF INFRASTRUCTURE BOND MONIES HAS ALREADY STARTED:

SAYS: "WE BECAME AWARE VERY QUICKLY, BACK TO FEBRUARY OF THIS YEAR, THAT THERE WERE BEING ATTEMPTS MADE, BY ATTORNEY GENERAL JERRY BROWN, AND PROBABLY OTHERS, TO TRY AND TIE UP THE USE OF NOT JUST THOSE FUNDS, BUT ANY TYPES OF FUNDS, BASED ON AB32 REGULATION. THERE ARE NO REGULATIONS ON AB32. EVENTUALLY THERE WILL BE, AND PEOPLE WILL COMPLY WITH THEM, BUT RIGHT NOW THERE ARE NONE. HE IS TRYING TO FORCE PEOPLE TO COMPLY WITH REGULATIONS THAT DO NOT EXIST, AND WE CALL IT JUST BASICALLY LAWSUIT ABUSE. HE HAS FILED LAWSUITS AGAINST VARIOUS COUNTIES, AND HE'LL PROBABLY FILE MORE, SO WE'RE GOING TO BE SPENDING MONEY THAT SHOULD BE GOING TO ROADS IN LAWYERS ON BOTH SIDES OF AN ISSUE OF WHICH THERE'S NO ISSUES."

LIVE: STATE SENATOR CAROLE MIGDEN WILL FACE ONE MISDEMEANOR CHARGE FOR TWO TRAFFIC COLLISIONS IN SOLANO COUNTY IN APRIL. THE CHIEF DEPUTY DISTRICT ATTORNEY IN SOLANO COUNTY WOULD NOT SAY WHAT THE CHARGE WOULD BE UNTIL IT IS FORMALLY FILED IN COURT TOMORROW.

THE CHIEF DEPUTY D-A MET WITH MIGDEN'S ATTORNEYS YESTERDAY TO TELL THEM THE SENATOR WOULD BE CHARGED WITH A MISDEMEANOR COUNT. HIGHWAY PATROL INVESTIGATORS RECOMMENDED THE SENATOR BE CHARGED WITH MISDEMEANOR RECKLESS DRIVING RESULTING IN BODILY INJURY FOR THE REAR END COLLISION THAT SENT A WOMAN AND HER TODDLER TO THE HOSPITAL, AND MAKING AN UNSAFE TURNING MOTION FOR MIGDEN'S COLLISION WITH THE GUARD RAIL. THE SAN FRANCISCO DEMOCRATIC SENATOR IS IN HER DISTRICT TODAY. HER PRESS SECRETARY REFERRED QUESTIONS TO MIGDEN'S POLITICAL ADVISOR WHO DID NOT RETURN PHONE CALLS.
