Murder charges have been filed in a 10-year-old cold case in which an infant boy was murdered, the El Dorado County District Attorney's Office announced Wednesday.
David Paul DeMartile Sr., the baby's father, who is serving a 14-year prison sentence for burglary, is charged with the murder.
The 3-week-old baby was reported unresponsive in 2010 in South Lake Tahoe, Deputy District Attorney Joe Alexander said. Emergency services personnel performed life-saving measures and took the baby to a hospital, where he could not be resuscitated. Initially, it was thought the baby died from sudden infant death syndrome, Alexander said.
An autopsy was performed and the cause of death was found out to be "consistent with child abuse," Alexander said.
The case went cold but was picked up and investigated by the El Dorado County Cold Case Task Force.
"DeMartile has always been a person of interest, but it was an ongoing investigation until we were satisfied we could prove the case beyond a reasonable doubt," Alexander said.
The District Attorney's Office will ask for DeMartile, who is being held in a state prison in Arizona, to be returned to California so he can be arraigned on the charges in El Dorado County. He will continue to serve his sentence for a burglary conviction in the El Dorado County jail.
