Kaepernick, two other players investigated in incident in Miami

Miami police are looking into an incident involving 49ers quarterback Colin Kaepernick, two other NFL players and a woman who claims she woke up in a hospital bed following a night of drinking with the players.

The other two players are 49ers receiver Quinton Patton, who is entering his second year in the league, and Seattle Seahawks receiver Ricardo Lockette, a former member of the 49ers who became close friends with Kaepernick and who was released by the team last year.

A police spokeswoman Thursday cautioned that the investigation is in its early stages and that no charges have been filed. And the incident report makes no mention that a crime occurred.

On April 1, according to the report, the woman went to a suite at the upscale Viceroy Hotel in Miami at 9 p.m. She told police she made drinks and served shots to the players. In the report, she said the players told her that in order “to drink the shots she had to ‘hit’ the bong which contained marijuana.”

After the group watched a basketball game on TV, the report said, the woman began feeling “lightheaded” and went to a bedroom where she was later joined by Kaepernick, 26, with whom she said she had a sexual relationship in the past.

Kaepernick then left the bedroom, according to the report, and the two did not have sex, the woman told police. The report says Patton, 23, and Lockette, 27, later peeked inside the bedroom and that the woman yelled, “What are you doing? Where is Colin? Get out!”

According to the report, the woman does not remember anything about the night after that, and she woke up in a hospital bed the following morning not knowing how she got there. The woman, whose name is redacted, reported the incident to police April 3, 48 hours after arriving at the hotel suite.

The web site TMZ, which was first to cite the investigation, reported that Kaepernick was the subject of a sexual assault investigation. That report was incorrect, a police spokeswoman said.

The 49ers released a statement from general manager Trent Baalke following TMZ’s report: “The 49ers organization is aware of the recent media report regarding Colin Kaepernick and is in the process of gathering the pertinent facts.”

Calls to Kaepernick’s agent were not returned.

Kaepernick, who in 2013 was voted a team captain by his teammates, trained last year with Lockette in the Atlanta area, and they lived together in Santa Clara until Lockette was released. They are training in South Florida this year.

The 49ers and Kaepernick are negotiating a multi-year contract extension that could make Kaepernick the team’s highest-paid player and one of the highest-paid players in the league.

Kaepernick and Patton were scheduled to be part of a large contingent of 49ers in South Florida for teammate Anquan Boldin’s “Q-Fest” festivities that began Thursday and benefit his hometown of Pahokee, Fla. Coach Jim Harbaugh also is attending the event.

Also scheduled to attend is 49ers receiver Michael Crabtree, who was interviewed by police in connection to an alleged sexual assault in San Francisco early in 2013. Charges were not filed in that case.

Two years ago, 49ers linebacker Aldon Smith was arrested in Miami Beach for DUI, charges that were reduced to reckless driving. The 49ers since have had numerous police-blotter type incidents, including center Daniel Kilgore’s arrest for public intoxication in Tennessee in February and cornerback Chris Culliver’s hit-and-run incident involving a bicyclist in San Jose last month.

Culliver has an arraignment hearing today in San Jose. Also on the court docket is a discovery hearing for Smith relating to a separate DUI incident in September and gun possession charges that were filed last year.
