Carmichael tenant charged $1,800 a month despite mold and bugs, lawsuit says
A man is suing the owners of a Carmichael apartment complex alleging the unit he paid nearly $1,800 a month to rent had toxic mold and bug infestations.
Joshua Alan Daniels’ issues at Westwood Apartments, near the corner of Marconi and Root avenues, began in February 2024, according to the lawsuit filed last week in Sacramento Superior Court.
From February through June 2024, he submitted maintenance requests regarding a heater problem, the dishwasher not draining, rain coming through the windows, the heat not working and a bug infestation, the suit alleged.
In June and August 2024, county code enforcement officers taped notices on the door saying the unit lacked proper weather stripping, windows in disrepair, bug infestation and a broken lock on the front door, the suit alleged.
Daniels did not have hot water for five days in March 2025, which he reported, the suit alleged. His one-year lease ended that month.
The suit names property manager Greystar California Inc., property owner CR Westwood Communities LLC and Westwood Sorrento Montana LLC as defendants. According to California Secretary of State documents, Greystar California is based in South Carolina; Westwood Communities LLC is based in San Diego and Westwood Sorrento Montana LLC is based in La Jolla.
An email to Greystar and voicemail to the apartment complex were not immediately returned.
The suit, which seeks damages, claims violation of state and local housing laws — failure to provide habitable dwelling, private nuisance unfair competition and negligence
Residents of different Sacramento-area complexes have sued Greystar California in recent years with similar allegations.
In March, 24 plaintiffs who together had 23 children sued Greystar, along with 6058 Riverside Blvd. Partners LLC, over alleged poor conditions at a Greenhaven apartment complex, according to Sacramento Superior Court records. The units had roaches, plumbing issues, rats, leaky windows and roofs, mice and electrical problems, the suit alleged.
In 2022, 11 adults who together had 15 children sued Greystar California and Carmel Capehart LLC over alleged poor conditions at the Arbors at Antelope Apartments in Antelope. They alleged the units had dust mites, roaches, plumbing and electrical issues, fleas, bed bugs and defective heaters.
