Folsom student’s schoolyard injury sparks lawsuit for school district
A schoolyard incident last May has now sparked a lawsuit against the Folsom Cordova Unified School District.
Parent Eric Ly filed the lawsuit March 30 after his 12-year-old son sustained “severe head trauma” while playing two-hand-touch football at Folsom Middle School. In the complaint, Ly states students were allowed to play on blacktop during school hours, causing the student to hit his head on the pavement.
“Regardless of whether the school instructed the students to play on the blacktop or just permitted it, the school had prior notice that students routinely played football on the blacktop and allowed this practice to continue despite the foreseeable risk of injury from falls on hard surfaces,” the complaint states.
After incident, the complaint states, school staff took the student to the nurse’s office in a wheelchair and contacted the student’s mother. The family lived in Rancho Cordova at the time of the incident.
“Despite his obvious signs of concussion and severe pain, no ambulance was called,” the complaint states.
District spokesperson Angela Griffin on April 3 said the district has not received the summons yet. Once received, she said, the district will work on the case.
“Once the district is notified of any lawsuit, we work closely with our insurance provider and legal counsel to respond appropriately,” Griffin wrote in an email. “During the ongoing legal process, including the document discovery phase, we respect all aspects of privacy as protected by the legal process.”
Ly seeks damages for medical expenses, loss of earnings, loss of earning capacity and further economic and noneconomic damages as determined during trial, according to the complaint.
The Sacramento County Office of Education and State of California Department of Education are also listed as defendants in the case.
