Man sentenced for child sex abuse could get elderly parole, Sacramento County DA says

A Sacramento Superior Court judge sentenced a man to 71 years to life in prison for sexually abusing five children, including some abuse that stemmed from an in-home day care center his parents owned.

Prosecutors said the man convicted of child sexual abuse that spanned nearly three decades will become eligible 18 years from now.

Judge David Bonilla sentenced Jerry Don Egy, 47, on Friday, the Sacramento County District Attorney’s Office announced Monday in a news release. Egy remains in custody at the Sacramento County jail awaiting transfer to a prison. He’s been in custody since his June 2022 arrest.

On Sept. 20, Egy pleaded no contest to three counts of committing a forcible lewd act upon a child, along with two counts of committing a lewd act upon a child and forcible oral copulation, according to the District Attorney’s Office.

Prosecutor said Egy sexually abuse five children, ages 8 to 11. When he was arrested two years ago, prosecutors alleged in a filed criminal complaint that Egy sexually abused three girls. Two additional victims were later discovered.

Some of the abuse was associated with Egy’s connection to an in-home day care center owned and operated by his parents, who were not accused of being complicit with the alleged crimes, sheriff’s officials said at the time of his arrest. One girl was sexually abused when she was aged 8 to 11 years old at some point from Feb. 17, 2016 through Feb. 16, 2020, according to the criminal complaint.

Prosecutors said on Monday that there were two victims aged 8 to 11 years old, and Egy sexually abused the one these victims on multiple occasions over several years and told her not to tell anyone. The abuse inflicted on the other child included Egy holding down the girl and forcing her to watch pornographic videos, according to the District Attorney’s Office.

The criminal complaint alleged Egy committed repeated child sexual abuse with victims at various times from Oct. 20, 1995 through Nov. 16, 2018.

When he 19 or 20 years old, Egy sexually abused two 13-year-old children, prosecutors said in Monday’s news release. They also said Egy, when he was in his 40s, forcibly sexually abused a teenage girl after giving her methamphetamine.

Under California law, Egy will become eligible for early release at an elderly parole hearing after serving 20 years of his 71 years to life prison sentence, according to the District Attorney’s Office. With credit for time already served in custody, prosecutors said Egy will become eligible for parole 18 years from now.

Depending on a person’s conviction and prison sentence, an inmate may be eligible for elderly parole after being incarcerated at least 20 years and reaching 50 years of age, or being incarcerated at least 25 years and reaching 60 years of age, according to the California Department of Corrections and Rehabilitation. Convicted offenders sentenced to death or life without the possibility of parole are not eligible for elderly parole.
