A driver was injured after New York police said he pointed a fake gun at another car and crashed into the vehicle as he started to pass them in a fit of road rage.

The driver and passenger of the other car told authorities that a man whom they didn’t know drove up behind them and “began driving in an erratic manner” in Sullivan, about a 110-mile drive east from Rochester, on Oct. 13, according to New York State Police.

That’s when the man, Gary Moth, started passing them in an oncoming traffic lane and pointed a weapon that looked like a black handgun at them, state police said in an Oct. 14 news release.

Moth then slammed into their car and lost control of his vehicle, which rolled over, according to police, who said they received a report of the “accident” around 11:59 a.m. that day.

Moth, 54, of Chittenango, was arrested on charges of second-degree menacing, fourth-degree criminal possession of a weapon, seventh-degree criminal possession of a controlled substance, aggravated unlicensed operation, and received additional tickets.

Information regarding his legal representation wasn’t immediately available.

When authorities responded to the scene, they found a “replica Glock model pellet handgun” and methamphetamine inside Moth’s car, police said.

He was detained and had a minor injury from the crash, resulting in him receiving treatment at a medical center, according to police.

Moth received appearance tickets and is due in the Town of Sullivan Court on Nov. 12, police said.
