Stepdad said he was ‘too fat’ to sexually assault teen, CO officials say. He’s sentenced

A man who Colorado prosecutors say told investigators he could not have sexually assaulted his stepdaughter because he was “too fat” and gay has been sentenced.

The 44-year-old man was sentenced to 80 years to life in prison after a jury found him guilty of sexually assaulting his teenage stepdaughter, the 18th Judicial District Attorney’s Office said in a March 4 news release.

“The defendants worked together to present an array of ridiculous excuses, but DNA left no doubt in the jury’s mind regarding the defendant’s guilt,” Chief Deputy District Attorney Jacob Kremin said in the release.

In 2020, the 19-year-old stepdaughter called Aurora police and told detectives that she “had been assaulted multiple times starting from age 15,” prosecutors said.

The woman told police that she performed sex acts with her stepfather to avoid being beaten, according to prosecutors.

While speaking with her, a detective noted a 4-inch long scar on her back, which she said was from when her stepfather used a fork to scratch her, prosecutors said.

The detective also noticed another scar on one of her shoulders, prosecutors said. This one, the woman said, was from when her stepfather branded “her with a knife that he heated up on a stove top,” according to prosecutors.

The branding included the initials “RB,” which the woman thought to be in reference to the first names of her stepfather and mother, prosecutors said.

The woman said her mother would occasionally “join in the abuse” with her stepfather, prosecutors said.

When police detectives took her report, the woman told them she was last sexually assaulted the day before, prosecutors said.

Detectives took her clothing for DNA testing, according to prosecutors. Police also took a DNA sample from the stepfather.

Through testing, police found the DNA on the woman’s “underwear and body” was a match to her stepfather’s, prosecutors said.

When police questioned the stepfather, he told them “he was unable to have sexual intercourse due to the size of his belly fat and small size of his genitalia,” according to prosecutors.

The man also told investigators “he had an alternate sexual orientation,” making “him disinterested in the conduct alleged,” prosecutors said.

He stood by the statements he made to investigators when he testified in court, prosecutors said.

The jury ultimately found him guilty of three counts of sexual assault on a child by a person in a position of trust, three counts of aggravated incest and one count of second-degree assault, prosecutors said.

The same jury found the woman’s mother guilty of two counts of aggravated incest, prosecutors said. She was sentenced to “four years to life in prison, followed by 20 years to life of sex offender intensive supervision.”

“It’s appalling that a mother and stepfather would repeatedly abuse someone they were supposed to love and support,” Assistant District Attorney Ryan Brackley said. “While no length of time in prison will undo the trauma the victim of these horrible crimes endured, we hope these sentences will offer her some measure of healing.”
