Mom finds video of incapacitated daughter’s sexual assault, OR officials say
A man accused of sexually assaulting his then-girlfriend and recording it using her phone is heading to prison, Oregon officials said.
The 28-year-old was sentenced to nine years and three months behind bars following his conviction for first-degree sodomy and first-degree sexual abuse, the Lincoln County District Attorney’s Office said in a June 3 news release.
McClatchy News isn’t naming the man to protect the former girlfriend’s identity.
His attorney couldn’t immediately be reached June 4 for comment.
The man is accused of forcing his girlfriend into oral sex in 2020 while she was intoxicated, according to prosecutors. “The jury found that (she) was both mentally incapacitated and physically helpless at the time of the act and was unable to consent,” prosecutors said.
The girlfriend’s mother later found the recording, and the girlfriend made a report to law enforcement, according to prosecutors.
The man was indicted in 2021, but he couldn’t be located, and an arrest warrant was issued, prosecutors said.
He eventually was found and brought from Arizona to Oregon, where he was convicted after a jury trial, according to prosecutors.
During sentencing, Jenna Wallace, Lincoln County district attorney, “expressed concerns regarding (the man’s) inability to take responsibility for his criminal conduct and the harm that he caused,” prosecutors said.
Prosecutors added that the man’s “only comment to the court before sentencing was, ‘I’m already damned, so smite me.’”
Lincoln County is in western Oregon and includes Newport.
