Elk Grove Police Department to conduct DUI checkpoint. Here’s when

The Elk Grove Police Department will conduct a sobriety and driver’s license checkpoint this Friday, the agency said in a news release.

The check will be inside the city limits between 7 p.m. Friday and 3 a.m. Saturday. The exact location is undisclosed.

“The checkpoint will focus on removing impaired drivers, as well as unlicensed drivers from the roadways,” the release said. Educational materials on the dangers of driving under the influence will be handed out to those who go through the checkpoint.

The funding for the checkpoint was provided through a grant from the California Office of Traffic Safety.

California law requires drivers to stop and submit to a sobriety checkpoint when required by law enforcement.

However, drivers are not legally obligated to submit to a field sobriety test, pre-arrest test or cheek swab, according to the Law Offices of Grech and Packer in Riverside. There is also no state or federal law that prohibits someone from turning around or finding another route instead of going through the checkpoint, as long as it is safe to do so, according to Shouse California Law Group.

The California Department of Motor Vehicles has the authority to revoke or suspend the driving privilege of someone stopped by law enforcement for driving under the influence. Drivers charged with a first-time DUI can also face an average of $13,500 in fines, fees and more.
