Arrest warrant for former El Dorado Hills CSD official indicted on felony perjury charges

El Dorado County’s grand jury has indicted former El Dorado Hills Community Services District General Manager Kevin Anthony Loewen on felony perjury and financial conflict charges, and a warrant has been issued for his arrest, authorities said.

The El Dorado County District Attorney’s Office announced the indictment in a brief news release Friday afternoon.

“A warrant has been issued for his arrest,” the office said in the statement.

Loewen faces two counts of felony perjury as well as a single felony count of participating in a government contract while having a financial interest. The indictment also includes three misdemeanor counts of participating in a government decision while having a conflict of interest.

A person who answered a phone number associated with Loewen ended the call after learning the caller was a reporter.

The brief two-page indictment filed Thursday in El Dorado Superior Court centers on Loewen’s consultant work for national public finance firm David Taussig and Associates, or DTA, and his attempts to push through a contract between DTA and El Dorado Hills while head of the community services district.

Jurors who handed up the indictment also allege Loewen lied about his relationship with DTA on his state Form 700 — the financial disclosure required of public officials who make or influence government decisions — in documents filed in January 2023 with the Fair Political Practices Commission.

Grand jurors also alleged Loewen in June 2023 — just months before he stepped down as general manager that December — participated in the drawing of an annexation services contract between DTA and the district. Such contracts allow companies to annex properties to obtain district services.

Loewen also faces a trio of misdemeanor counts for attempting to use his position as general manager to influence the outcome of the contract and for approving more than $21,000 in payments between the company and the district.

In December 2023, Loewen abruptly left his $230,000-a-year position at the district, where he had served since 2017.

Loewen’s hasty exit came months after El Dorado Hills residents voiced concerns over possible ethics and contract violations.

A confidential investigative report on Loewen’s alleged conduct commissioned by the district in August 2023 after residents’ complaints and since released online laid out the findings. Loewen resigned before the report’s release.

The report by Sacramento firm Van Demyden Makus concluded Loewen performed part-time work as a business development consultant and senior manager for David Taussig and Associates, the national public finance consulting firm, throughout his time leading the district.

The report found that in the year before he abruptly stepped down in 2023, Loewen “deliberately withheld material information” from El Dorado Hills Community Services District’s board of directors “that would have been relevant to their consideration in consenting to his outside consulting work for DTA.”

DTA paid Loewen $5,000 per month, later hourly, from early 2022 through May 2023, for “business development” work while he continued as general manager.

The report also concluded Loewen’s role as general manager and his consulting work for DTA “created a situation where his personal, financial interests could conflict with the district’s interests,” violating district conflict-of-interest and outside employment policies.
