Yolo DA: Man sentenced for lewd act in Davis park. He’d done it before in the same city
A Yolo County judge on Monday sentenced a man convicted of masturbating in front of jogger at a Davis park in 2018, a crime he committed about a year after he did something similar at a parking lot in the same town, prosecutors said.
Martin Rios on Jan. 13 was found guilty of indecent exposure and lewd conduct, along with violating probation for his previous conviction.
On Monday, Superior Court Judge David Reed sentenced Rios to 60 days in jail and 240 hours of community service, the Yolo County District Attorney’s Office announced in a news release. The judge also ordered the 24-year-old Davis man to register with authorities as a sex offender for 10 years and serve three years of probation.
Rios’ latest indecent exposure crime occurred about 7 a.m. June 28, 2018. Prosecutors said Rios was sitting in his car at Slide Hill Park with his pants down and his door open.
He said “good morning” to a female jogger passing by. When the jogger turned and looked in his direction, she realized Rios “staring at her intently, grinning and masturbating,” according to the release. The terrified jogger left the area and called police the following day.
Davis police officers investigating reports of public masturbation from 2017 and 2018 matched a suspect description from the June 2018 jogger to a suspect description from the victim in a public masturbation incident the year before.
On April 19, 2017, Rios was in the parking lot in 500 block of First Street in Davis. Prosecutors said Rios was masturbating in the sight of a female victim who had parked nearby. The victim called police and Rios was arrested as he was leaving the parking lot. He was later convicted and sentenced to serve probation time for the 2017 incident after pleading no contest.
Officers presented a photo lineup to the jogger in the 2018 incident and she identified Rios as the suspect who victimized her, according to prosecutors.
