Sacramento police have made two arrests related to Sunday’s deadly shooting in downtown Sacramento that killed six people and injured 12.
Who are the suspects?
Dandrae Martin, 26, was named a “related suspect” in the shooting.
His older brother, Smiley Martin, 27, was also arrested in the shooting.
After shots were fired around 2 a.m. Sunday near 10th and K streets in downtown Sacramento, Smiley Martin was found wounded near the scene with serious injuries. He was taken to the hospital for medical treatment, and once his condition stabilizes, he will be booked into the Sacramento County Main Jail, where his brother is being held without bail.
Daviyonne Dawson, 31 — who was seen carrying a firearm after the incident — was the third arrest from the shooting. “At this time, Dawson is not charged with crimes directly related to the shootings,” police said.
What are they charged with?
Dandrae Martin was arrested on charges of being a felon possessing a firearm and for assault with a deadly weapon.
He also is being held on an outstanding warrant from the Riverside County Sheriff’s Office, jail records say.
He appeared in a cage in a jailhouse courtroom and spoke only once to confirm his name to Superior Court Commissioner Ken Brody.
“Yeah,” Martin said, when asked if that was his name.
The Public Defender’s Office declared an overload, and the case was assigned for now to lawyer Linda Parisi, who said there would be a decision later on which defense attorney would represent Martin and other defendants.
After court, Parisi described her client as “very somber, very somber.”
“You saw in court, this is very serious,” she said.
Dandrae Martin will appear in court again April 26.
Riverside Superior Court records show Dandrae Stephan Martin has a 2014 conviction for inflicting corporal injury on a spouse. He also has 2018 convictions in Maricopa County, Arizona, for a count of criminal damage and a marijuana violation, as well as 2016 conviction of aggravated assault and domestic violence by impeding breathing, according to online records in Phoenix. Dandrae Martin is scheduled to make his first court appearance Tuesday in Sacramento.
Smiley Martin was arrested on charges of being a prohibited person in possession of a firearm and for possessing a firearm.
He has a criminal record stretching to 2013 and last year was the subject of a plea by Sacramento County District Attorney Anne Marie Schubert’s office that he not win early release from prison, where he was serving a 10-year sentence for domestic violence and assault with great bodily injury. Despite a two-page letter to the Board of Parole Hearings urging that Martin remain in custody, he won his release and was in Sacramento on Saturday night recording himself on a Facebook Live video brandishing a handgun hours before the shooting.
Daviyonne Dawson was arrested on the charges of being a prohibited person in possession of a firearm. Police said that Dawson was not charged with crimes “directly related to the shooting,” and detectives believe the gun recovered was not used in the shooting.
Sacramento Superior Court filings show Dawson has been charged in felony cases in 2012, 2014 and 2015, but online records no longer divulge the nature of the charges or the outcome.
Timeline of shooting arrests
Dandrae Martin was arrested early Monday morning and his brother Smiley Martin was taken into custody by Sacramento Police Department detectives on Tuesday, police said.
Daviyonne Dawson was arrested late Monday by police.
What police are saying about shooting
Law enforcement officials believe the shooting occurred between two groups of men firing at each other involving at least five shooters. The incident is now being called a gang related.
“As detectives learn more about the shootings, it is increasingly clear that gang violence is at the center of this tragedy,” police said Wednesday.
Detectives are still working to identify gang affiliations for others who may have been involved.
